1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and YourForm ("we," "us," or "our"), concerning your access to and use of our website and services.

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, then you are expressly prohibited from using the Service and must discontinue use immediately.

2. Google API Compliance

Our Service integrates with Google APIs. Your use of these integrations is also governed by Google's APIs Terms of Service. We strictly adhere to Google's API Services User Data Policy, particularly regarding the limited use of user data.

3. User Responsibilities & Acceptable Use

You are solely responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• The content of any forms you create and the data you collect.

You agree NOT to use the Service to:

• Collect sensitive personal information (such as credit card numbers, SSNs, or health data) in violation of applicable privacy laws.
• Distribute malware, viruses, or any phishing scams.
• Violate any applicable national or international law or regulation.

4. Fees, Payments, and Refund Policy

Service Fees: Certain aspects of the Service may be provided for a fee or other charge. If you elect to use paid aspects of the Service, you agree to the pricing and payment terms, as we may update them from time to time.

No Refunds: WE DO NOT OFFER REFUNDS. All payments made through the Service are final and non-refundable. You may cancel your subscription at any time, but you will not receive a refund for any prepaid fees or unused portion of your subscription. Upon cancellation, you will continue to have access to the Service until the end of your current billing cycle.

5. Intellectual Property & Data Ownership

Data Ownership: You retain absolute ownership of all content created or collected on the Service. This includes your form definitions, logic configurations, respondent data within your Google Sheets, and any files uploaded to your Google Drive via the Service.

Service as a Conduit: YourForm operates as a management interface for your Google Workspace. By using the Service, you acknowledge that your data is stored within your own Google account. We act as a conduit for the processing and visualization of this data.

Third-Party Integrations & Keys: For features involving Webhooks or Audio processing via ElevenLabs, you are responsible for providing your own API keys. YourForm only facilitates the transmission of data using your credentials; you remain responsible for the privacy practices and compliance of these third-party services.

Deletions are Permanent: When you delete a form using YourForm, the Service will also attempt to delete the corresponding spreadsheet and files from your Google account. This action is permanent and cannot be undone by us.

Proprietary Assets: The designs, interface code, and system logic of YourForm remain our exclusive property.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THE SERVICE.

7. Limitation of Liability

IN NO EVENT SHALL YOURFORM BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA OR PROFIT, OR DUE TO BUSINESS INTERRUPTION) ARISING OUT OF THE USE OR INABILITY TO USE THE MATERIALS ON YOURFORM'S WEBSITE, EVEN IF WE HAVE BEEN NOTIFIED OF THE POSSIBILITY OF SUCH DAMAGE.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
